I have researched the facts regarding a personal injury action against Paul Joseph, as well as a medical malpractice action against the medical providers.

Howard White sustained an on the job burn which has entitled him to receive workers compensation. While Howard’s injury has kept him out of work for a week, workers compensation’s law states that an injured worker is entitled to temporary income benefits on the 8th day of disability. Unless Howard’s disability persists for 4 or more weeks, benefits will not be paid for the 1st week of lost wages.

Case Study: A Revealing Message Tommy was waiting one day after class to talk to Mrs. Rosa about Ally, one of his closest friends in the eleventh grade. She had been acting weird over the last couple of weeks and something wasn’t sitting right with Tommy. I spoke with Corey at approximately 8:45am. I asked him for an update in the claim, particularly regarding the physical therapy. The physical therapy was requested by the treating physician. Initial treatment will be 2 times per weeks for 3 weeks. The therapy is for an unspecified strain/contusion. Richard’s next doctor’s appointment is on May 5th. No notice in the file that he is required to wear a sling.

In Baker v. Willoughby [1970] AC 467 the defendant negligently injured the claimant's leg in a car accident. The claimant was later an innocent victim when shot in the same leg by some robbers and the leg was amputated. The House of Lords held that the defendant was liable to pay full compensation for the injury he had caused, based on the claimant's losses beyond the time when his leg was amputated. Since the claimant's disability would have been permanent, damages were assessed as if the second event had not occurred. If the chain had been treated as broken and the defendant had had no liability in respect of the period after the claimant's leg had been amputated, the claimant would have fallen between two sets of defendants (the robbers were not available as defendants to pay their share of full compensation). This decision was criticised in Jobling v. Associated Dairies [1982] AC 794 where the claimant's employer negligently caused a slipped disk
