What factors contribute to the presidency? The president needs the character for faithful leadership to Preserve Protect and Defend the Constitution (Foundation National Executive). James Madison states, “Duty, gratitude, interest, ambition itself, are the chords by which they will be bound to fidelity (continued loyalty and support) and sympathy (concern) with the great mass of the people” (Course Reader, Federalist 57). The National Government derives its Political Power from “we the people” 330 million people, 50 states, and 1 nation (New Federalism). The president must consider his people. Every desire and need must be taken into account by the president. "We the people" value that our president complies with our commands and pays attention to our wishes, making them a dependable leader. The personality of the president is the spirit used to connect with 330 million citizens to get “we the people” to act in accordance with the Social Contract (Foundation National Executive). The presidency was established by Article II of the Constitution, which states “The executive power shall be vested in a President of the United States of America” (American Government 176). Article II describes the procedure for choosing the President, the extent of the President's authority and responsibilities, and how to remove a President from office. James Madison stated, “Every consideration, such as honor, oaths, reputations, conscience, the love of country, and family affections and attachments, afford security for fidelity” (Course Reader, Federalist 57). The Oath of Office claims, “I do solemnly swear or affirm that I will faithfully execute the office of President of the United States, and will to the best of my ability, preserve, protect, and defend the constitution of the United States” (Constitution Article 2 Section 1). This demonstrates the president's commitment to uphold the constitution.
The president preserves, protects and defends the principles of the Social Contract consented to in the Declaration of Independence and Constitution (Community National Executive). The nation's government would be efficient and effective under the presidency. The president is required to diligently carry out the laws and not to disregard them out of personal distaste. The original intent was to place constituted power in the proper government authority to protect the Natural Equality and the Natural Rights to Life, Liberty and Pursuit of Happiness of the people (Outcome New Federalism). The ability to pass laws rests with both the president and Congress, but they have occasionally received this authority during terrible times. The president's law making rights were tested in the Supreme Court Case Youngstown Sheet & Tube Co. v. Sawyer in 1952. The Supreme Court stated lawmaking “The mill owners argue that the President’s order (execute order) amounts to lawmaking, a legislative function which the Constitution has expressly confided to the Congress, and not to the President” (Youngstown Sheet & Tube Co. v. Sawyer). Every four years, "we the people" choose the president who will represent us as our representative. The question is do we ponder on why we vote and the law so we can achieve the presidency by faithful leadership and personality? It is crucial to know “The Government of the Union then is, emphatically and truly, a Government of the people” or else who would influence our government (Course Reader, McCulloch v. Maryland).
